Procedure 02-01 Identification of Local Building Codes

Scope

Statutory Authority (20 ILCS 3918/55)

Beginning on the effective date of this amendatory Act of the 92nd General Assembly, a municipality with a population of less than 1,000,000 or a county adopting a new building code or amending an existing building code must, at least 30 days before adopting the code or amendment, provide an identification of the code, by title and edition, or the amendment to the Commission. The Commission must identify the proposed code, by the title and edition, or the amendment to the public on the Internet through the State of Illinois World Wide Web site. The Commission may adopt any rules necessary to implement this Section. For the purposes of this Section, ("building code") means any ordinance, resolution, law, housing or building code, or zoning ordinance that establishes construction related activities applicable to structures in a municipality or county, as the case may be.

Purpose

This procedure allows applicable municipalities and counties to comply with the statutory requirements of Public Act 92-489. Compliance consists of a submittal that identifies code adoptions or amendments in order for the Commission to post the data on its website for informational purposes. Public Act 92-489 mandates this as an informational resource for the construction industry, state, county and local jurisdictions interested in recent building code activity. Interested parties that locate a particular code adoption or amendment to an existing code can obtain additional information from the local municipality or county making the change. Due to copyright laws, the Commission cannot provide full text copies of new code adoptions or amendments in print or online form. The statutory intent is strictly informational.

Timelines

Per section 55 of the Illinois Building Commission Act (20 ILCS 3918/55), Municipalities and Counties shall submit the required form 30 days prior to adopting or amending an existing building code and provide an identification of the code, by title or edition, or the amendment language to the Commission.

Record Keeping

The Commission maintains all written and database files in accordance with all applicable state and federal laws. The CDB provides a section [County/Municipal Code Reporting] of the current website (county/municipal code reporting form) listing all activity submitted. After 60 days this information is no longer visible on the website but is retained in the archived directory of building code submittals.

Submission Format

The CDB shall accept information in the following formats:

a) Completion of the attached form returned by fax to 217.542.4208 or mailed to the following address:

c) Full text copies of code adoptions or amendments are unnecessary.

Reporting Criteria

The Commission shall be notified of the following instruments on construction related activities applicable to structures in a municipality or county.

a) Ordinance
b) Resolution
c) Law
d) Housing or Building Code
e) Zoning Ordinance

Exceptions

Municipalities with a population of 1,000,000 or more are exempt (20 ILCS 3918/55).
* Participation by Fire Protection Districts is voluntary.
